Defense Prepares Appeal, Gotovina Precedent Seen as Hope

The fight over the first-instance claims against the former leaders of the Kosovo Liberation Army has now moved to the Appeals level. While the defense is preparing arguments to overturn the verdict, international lawyers assess that the Court went beyond its competencies by characterizing the means of the war for statehood as criminal.

How much this decision can change at the second level and why the defense’s experience in similar cases at the Hague Tribunal is seen as a turning point.

The legal battle for the truth of the Kosovo Liberation Army’s war has now moved to the second level of the Specialist Court. International lawyer Luka Mishetiq, who is part of defense teams in this process, has reacted sharply to recent interpretations of the verdict against Kosovo’s former war leaders.

In an open rebuttal to Marko Prelec of the International Crisis Group, Mishetiq clarified that although the Court had no jurisdiction to judge Kosovo’s right to independence, it attempted to criminalize the means used for the country’s liberation.

Through a reaction on the X platform, Mishetiq noted that the Court made an unprecedented legal leap.

“The Trial Panel decided that part of the purpose of members of the Joint Criminal Enterprise and others in the KLA leadership was for Kosovo’s independence to be achieved through war crimes. Even the Prosecution didn’t go that far,” Mishetiq underlines.

This first-instance finding is being assessed as an unfounded blow that strikes at the core of Kosovo’s liberation cause. However, this situation is not seen as irreversible for the four former leaders of the Kosovo Liberation Army, held in The Hague. From the perspective of the country’s jurists, the high preparation of defense teams and their international experience could bring a radical turn at the second level.

Such optimism is also supported by precedents of the Hague Tribunal for former Yugoslavia, precisely in the case of Croatian general Ante Gotovina.

“Here we must keep in mind the case of Croatia with general Ante Gotovina, who was convicted in the first instance but acquitted on appeal. We wish the same fate would follow our leaders too, especially considering that the defense is led by the same lawyer, Luka Misetiq,” said lawyer Florim Shefqeti.

The Gotovina case is serving as the main reference point for the defense and legal experts, who expect the next phase of the process to strip the verdict of political loads.

Eyes are now turned to the Court of Appeals. The defense’s new arguments for the four former KLA leaders are expected to be unveiled as soon as the notice of appeal is officially filed, formally starting the procedures to overturn the first-instance decision.
