Halle Berry’s ex-husband accuses her of abusing their son, court issues a protective order against the actress

A Los Angeles County judge has issued a temporary restraining order against American actress Halle Berry at the request of her ex-husband Olivier Martinez, who accused her of verbal abuse against him and physical abuse against their 12-year-old son Maceo, while her lawyer dismissed the accusations as completely unfounded and misleading.

A judge approved Martinez’s request for a temporary restraining order for him and their son, according to court documents seen by People magazine.

The court temporarily modified the custody and child-visitation agreement, but did not bar Berry from contacting Maceo.

Her meetings with her son are now limited only to Mondays and Tuesdays from 10:00 to 20:00, and to Saturdays and Sundays at the same hours.

The temporary measure will be valid until the hearing scheduled for October 16, when the court will decide whether the order will be extended or lifted.

In the request filed by Martinez, it is said that Berry caused him “emotional and psychological stress because of the physical abuse of a minor child”, according to the document obtained by People.

Martinez claims that during the alleged incident, Berry “grabbed Maceo by the neck and began to choke him”, shouting, “Who is on top now?! Who is on top?” He also stated in the request that Berry allegedly used violence against him and their son in previous years.

Olivier Martinez’s lawyer, Patrick Bagdasarians, said that “his client’s most important concern is the health, well-being and safety of the minor child”, so he sought protection from domestic violence.

Another concern, as the lawyer stated, is that the mother receive “the proper help she needs to resolve her problems and recover, which in turn would help the child”.

Halle Berry’s lawyer, Marina Beck, assessed Martinez’s request as “completely unfounded and deliberately misleading”.

“To say that this request is completely unfounded and deliberately misleading would be an understatement,” Beck said, adding that Berry was “used to this kind of outrageous behaviour from Martinez”.

She said Berry was “deeply saddened”, but that this would not stop her fighting for “Maceo’s best interests” and giving him the love and support he needs.

The temporary restraining order was issued three years after Berry and Martinez finalized their divorce in 2023, after an eight-year dispute.
