KPK calls an urgent meeting, expected to discuss the performance of the SPRK chief prosecutor

The Kosovo Prosecutorial Council (KPK) has called an urgent meeting for today, 2 October, which is expected to be held behind closed doors to the public.

The meeting is scheduled to start at 15:00, while it is not yet officially known which issues will be on the agenda.

Sources say the meeting is also expected to discuss the performance of the Chief Prosecutor of the Special Prosecution of the Republic of Kosovo (SPRK), Blerim Isufaj.

The KPK’s urgent meeting comes a day after the Council’s regular meeting, held on 1 October, at which, according to sources, the issue of the SPRK chief prosecutor’s performance was also discussed.

Meanwhile, the Kosovo Law Institute (IKD) has reacted to this development, expressing concern about the calling of the meeting and asking that no actions be taken that could undermine the functionality of the Special Prosecution.

“IKD clearly stresses that accountability must not and cannot be used as a justification for decision-making with fast and unclear procedures against a chief prosecutor,” the reaction states.

IKD assessed that the issue must be treated carefully, taking into account the SPRK’s mandate in handling cases related to organised crime and transnational crime, as well as cooperation with other states.

The institute asked that any process that could affect the position or mandate of the SPRK Chief Prosecutor be conducted in accordance with the Constitution, the applicable law and judicial practice.

According to IKD, the evaluation of the chief prosecutor’s performance must be “professional, fair, impartial, objective and based on measurable indicators”, while also respecting prosecutors’ independence in handling individual cases.

In its reaction, IKD also mentioned the case of 2025, when the KPK had dismissed Besim Kelmendi from the position of acting Chief State Prosecutor.

“The Supreme Court itself annulled this decision as unlawful,” IKD’s reaction states.

IKD asked that this case serve as an institutional lesson and that the KPK avoid, in its view, hasty decision-making practices.

The institute stressed that accountability and the independence of the prosecutorial system must be applied in a fair, transparent and balanced manner.

“The demand for accountability must not be used as an instrument or a way to interfere in the functional independence of a prosecutorial office, just as independence cannot be used as a justification for a lack of accountability,” the reaction states.

IKD said it does not understand the urgency of such a meeting without all available legal remedies having been completed and exhausted.

Finally, IKD asked the KPK to ensure a fair and independent process and not to take actions that, according to the institute, would undermine legal certainty, the functionality of the SPRK and public trust in the KPK and in the independence of the prosecutorial system. /Telegrafi/
