Lawyer Mishetiq hits back at Marta Kos: “It’s not for you to prejudge the Thaçi case”

Hashim Thaçi’s lawyer, Luka Mishetiq, has pushed back against the statement of EU Enlargement Commissioner Marta Kos regarding the Kosovo Specialist Chambers.

After the verdict against the former leaders of the Kosovo Liberation Army, Kos called the Specialist Chambers an “impartial and independent judicial body”. She said the verdict relates to “individual responsibility and justice for the victims and their families from all communities in Kosovo”.

Mishetiq has said that the impartiality of the Specialist Chambers in the Thaçi case has yet to be determined and that Kos should not prejudge the matter.

“Whether the Kosovo Specialist Chambers acted impartially in the Thaçi case remains to be determined. It is not for Marta Kos to prejudge this matter,” Mishetiq wrote.

He attached a report by the Bar Human Rights Committee of England and Wales, which he said raises questions about the impartiality of the trial panel’s judges.

In the report, the Committee had identified serious problems regarding the protection of procedural guarantees, particularly concerning the right to a fair, transparent and impartial trial at the Specialist Chambers. The report also found that the Specialist’s mandate had drifted from its original purpose.

Meanwhile, on September 16, EU Enlargement Commissioner Marta Kos had called for the Specialist Chambers’ verdict against the four former KLA leaders to be respected. /Telegrafi/
