Sopjani: dissolving the Specialist Chambers is possible, but constitutional changes are problematic

Lawyer Shkëlzen Sopjani has stated that dissolving the Specialist Chambers in The Hague is possible, but according to him, such a process would face complicated procedures, including constitutional changes.

Speaking about the possibility of changing or ending the mandate of the Specialist Chambers, Sopjani, a guest on “FIVE” on Dukagjini, emphasized that the procedures for amending Kosovo’s Constitution also require the support of two-thirds of deputies representing non-majority communities.

“The change can be made, but there are some issues that also involve constitutional changes; now these constitutional changes are problematic, given the procedures needed to amend the Constitution of the Republic of Kosovo, which in this case also require 2/3 of the minorities, and with the Constitution these Special Chambers have a paragraph there in Amendment 162, which was an amendment to the Constitution precisely for the Specialist Chambers, which says that even after the end of the mandate, whether by law or by time — remaining or unfinished cases, it says, continue to be handled by the Specialist Chambers. This is the problem, because this issue too could be considered as having remained in procedure and unfinished,” Sopjani said.

He said that any attempt to change the status of the Specialist Chambers requires in-depth legal analysis, also taking into account the possible consequences in relation to international factors.

Sopjani also expressed that he has no doubt, according to him, that the latest judgment is political, and he linked it to the judge’s previous judgments within UNMIK.

“The changes require in-depth analysis and assessment, also taking into account the consequences that may come from internationals — I have no doubt that the judgment is purely political and in line with the judgments this judge has given also in UNMIK,” Sopjani said. /Tv Dukagjini
