Jurist Myftari against the changes to the Criminal Procedure Code: They limit the means of seeking evidence
Commenting on Prime Minister Edi Rama’s proposals for changes to the Criminal Procedure Code, in a live appearance on “Now with Erla Mëhilli”, jurist Kreshnik Myftari was critical, saying they would affect the investigative work of prosecutors and the Judicial Police.
Myftari argued that the changes would limit the means of seeking evidence and the investigative strategy, while also raising concern about a provision which, according to him, could create an opportunity for a more favorable law to be applied to measures imposed earlier as well.
“To make those changes, the whole Code would have to change. In my opinion, it is an amputation of the investigative activity of the prosecutor and the Judicial Police, an amputation of the means of seeking evidence, an amputation of the investigative strategy. These changes cut the prosecutor’s limbs off. This is the second attempt, because there is an earlier one too, with damage to the formula of the justice collaborator. The reason is to make a specific case — the favorable law has a certain possibility of being applied to measures given before as well. Not that it will be applied automatically, but they can find the machination,” he said.
