Magistrates’ salary law: voted in Parliament at midnight, decreed by the President in the morning, published at noon
The law changing how judges’ and prosecutors’ salaries are determined has now been published in the Official Gazette, officially entering into force.
Law no. 95/2026 was approved by Parliament in the early hours of 18 September, at around 01:30. During the morning, it was decreed by President Bajram Begaj and has now been published in the Official Gazette.
The amendments stipulate that the base reference salary for judicial and prosecutorial functions will be equal to 0.38 times the salary of the President of the Republic, while its indexation will be done by decision of the Council of Ministers, no later than two years from the last indexation.
The law also provides that changing the base reference salary will have effects only for judges, prosecutors and the members and president of the Constitutional Court. For other public officials and employees whose salaries are linked to a judge’s or prosecutor’s salary, the base reference salary set before decision no. 15, dated 17 February 2026, of the Constitutional Court will continue to be used.
The law enters into force immediately and extends financial effects from 1 April 2023, only for the salaries of judges, prosecutors, members and the president of the Constitutional Court.
