The May 11 investigative commission / Gjiknuri: The Constitutional Court’s decision is binding. Kaso: The procedural steps must be defined
The Legislation Council today reviewed the Constitutional Court’s decision on the parliamentary investigative commission into the May 11, 2025 elections, after the Constitutional Court struck down the Assembly’s decision that had rejected the establishment of this commission requested by the opposition. The chairman of the Legislation Council, Damian Gjiknuri, stated that the Constitutional Court’s decision is binding on the Assembly and that the procedural steps for implementing it must now be determined. He explained that the Legislation Council is the body which, under the Assembly’s Rules of Procedure and the order of the Speaker of the Assembly, must review the Constitutional Court’s decision and determine how the procedures will proceed.
“The Constitutional Court has returned it to the Assembly, that is, it has partially overturned this decision. It is understood that the appeal also had another object, but that object was rejected. It is known that the Constitutional Court’s decision is binding, so the Assembly will find the necessary modalities to bring this matter back once again,” Gjiknuri said.
From the opposition, Democratic Party MP Ivi Kaso asked that the procedures for implementing the Constitutional Court’s decision be sped up. According to Kaso, implementing the decision constitutes an institutional responsibility and is tied to the principle of constitutional loyalty among institutions. He also argued that the matter should be treated swiftly ahead of the next electoral period, stressing that the problems identified during the May 11, 2025 elections must be examined before the next elections.
“It is the responsibility of this Assembly to address it in the fastest possible time. It shows institutional responsibility and falls under the principle of constitutional loyalty that institutions must have toward one another. Let us find the way and the exact procedural steps for how to make this Constitutional Court decision a reality by detailing the procedural steps,” the DP MP said.
