The Specialist Court’s verdict overturned the reasons for which it was established

One of the fundamental reasons that led to the creation of the Kosovo Specialist Court in The Hague, or the “special mechanism,” was the need for the claims raised in Dick Marty’s Council of Europe report not to remain political accusations or the findings of a parliamentary report, but to be subjected to an independent criminal investigation and, where the investigation produced sufficient evidence, to a judicial process.

The Court itself says on its website that its jurisdiction relates to crimes connected with the allegations reported in the Parliamentary Assembly of the Council of Europe’s Report of January 7, 2011.

This task was initially taken up by SITF, the Special Investigative Task Force, while the Specialist Chambers were created later as the judicial institution where the cases resulting from these investigations would be examined.

At the heart of Dick Marty’s report was the accusation of criminal activity by the KLA, organ trafficking, the Yellow House and a series of fabricated facts that surpassed even the imagination of Hollywood’s best directors.

This was the reason that from the report they went to a resolution of the Parliamentary Assembly, then to the Special Prosecutor and then to the Specialist Court.

Now that the Specialist Court has delivered its verdict, the only thing that is not mentioned are the reasons for which it was created.

They were knocked down at the start and no longer mentioned are organ trafficking, nor mass crimes against Serbs, nor the inventions of the Serbian police chiefs who are the drafters of that report.

Naturally, this is a great victory for Kosovo and a triumph of truth over lies that were raised into an institutional system, and when an investigation process misses the reason for which it began, it should in fact be declared closed.

The crimes against the person, or other criminal findings that prosecutor Smith and his colleagues claim to have found for the former KLA leaders, could in this case be delegated to the Kosovo Prosecutor’s Office, since they were not created to duplicate it, but to investigate the major accusations that shook the foundation of the reason for which the war in Kosovo began.

The deviation from monstrous accusations, from organ trafficking and crimes against humanity, to crimes against the person, and the declaration as a criminal group of the four KLA leaders, is a hunt gone off-road, unverifiable by the standard that such a brutal accusation against several political figures requires.

So Dick Marty, the Council of Europe Resolution or the very creation of the Specialist Court had the goal of killing Kosovo, but since they found no facts, they are trying to kill the KLA leaders along the way. That is going out hunting to kill a bear, and since you cannot kill it, you kill whatever comes before you. The reasons for which the Court was established died before the end of the trial.
