They installed ‘inox’ pipes instead of copper and failed to honour the contract – indictment against two persons for abuse and fraud in public procurement

The Basic Prosecution in Prizren, Department for Serious Crimes, has filed an indictment against the defendant Xh.K., in his capacity as the responsible person of the legal entity ‘E.I.’ SH.P.K., as well as against the legal entity ‘E.I.’ SH.P.K., on the grounded suspicion that they committed the criminal offence of ‘Abuse and fraud in public procurement’.

According to the indictment, on December 10, 2022, in Prizren, the defendant Xh.K., in his capacity as owner and responsible person of the company ‘E.I.’ SH.P.K., deliberately violated public procurement procedures and rules and failed to fulfil the obligations set by the contract for ‘Regulating the central heating in the ballet hall at the ‘Lorenc Antoni’ Secondary Music School’.

‘The defendant Xh.K. used materials for central heating in breach of the obligations set out in the contract, installing galvanised and black-steel pipes, of ‘inox’ material, instead of installing copper pipes, which are not in accordance with the bill of quantities and estimates for carrying out the central heating works, as well as with the specifications for the supply and assembly of parts and equipment as in the contract, with the aim of benefiting himself, thereby causing material damage to the Municipality of Prizren,’ the announcement states.

Likewise, according to the indictment, the legal entity ‘E.I.’ SH.P.K. violated public procurement rules and failed to fulfil the contract obligations, with the aim of obtaining a property benefit.

The case prosecutor, upon filing the indictment, proposed to the court that, after holding the judicial review and administering and evaluating the evidence, the defendants be found guilty and punished according to the law. /Telegrafi/
