$120 Million Fine: U.S. Backs Musk in Legal Clash with the EU

The U.S. government has formally asked to intervene in Elon Musk and X’s legal case against the European Commission over a €120 million fine.

The U.S. Department of Justice filed the request with the General Court of the European Union in Luxembourg. Washington wants to take part in two cases in which X and Musk are challenging the European Commission’s decision of December 5, 2025. The U.S. argues the Commission has improperly expanded its regulatory powers over American companies.

According to the Justice Department, the decision could also affect other U.S. tech companies operating in Europe. The European Commission fined X after finding violations of three transparency obligations under the EU’s Digital Services Act.

The EU General Court is now expected to decide whether to accept the U.S. request to intervene in the cases.
