Constitutional Court rejects DP’s request over the People’s Advocate, Shabani’s election remains in force
The Constitutional Court has rejected the Democratic Party’s request regarding the election of the People’s Advocate, upholding the procedure through which Endri Shabani was elected to the post.
44 Democratic Party MPs sought verification of the procedure followed by parliament for electing the People’s Advocate, incompatibility in exercising the office, and annulment of parliament’s decision of December 11, 2025 electing Endri Shabani to the post.
Before the vote for the People’s Advocate, the Democratic Party had withdrawn its signatures for the candidates for the post, including Endri Shabani, declaring he no longer had its support.
Despite this, Shabani’s candidacy was voted on in plenary session by the majority and he was elected People’s Advocate.
With its decision, the Constitutional Court upheld Shabani’s election to the post, rejecting the request submitted by the 44 Democratic Party MPs.
In its full announcement, the Court said that on 29.09.2026 it reviewed in plenary session and on the basis of documents the case brought by a group of 44 MPs, seeking verification of the election procedure, the incompatibility question, and annulment of parliament’s decision no. 111/2025 of 11.12.2025 electing the People’s Advocate. The Court found the matter falls within its constitutional jurisdiction and dismissed the claims on the merits, deciding unanimously to reject the request. The reasoned final decision will be published within the legal deadlines provided by law no. 8577 of 10.02.2000 and the Court’s procedural rules, the announcement states.
