Trial for Ajola Xoxa, Constitutional Court sets the date for the Tirana mayor’s wife

The Constitutional Court has set November 24 as the day when it will review another complaint over the seizure of phones by the special prosecution.

After the case of journalist Elton Qyno and Onejda Ymeri, where the Constitutional Court set limits on SPAK not to block phones without a court decision and to maintain proportionality, the next case concerns Ajola Xoxa, the wife of the Mayor of Tirana Municipality.

In the calendar published by this court it is stated that Ajola Xoxa and the company Partners Law seek the annulment as incompatible with the Constitution of three decisions of lower courts.

Concretely, of the Special Court, First Instance, dated December 20, 2024, of the Special Court of Appeal, dated February 19, 2025, and of the Criminal College of the High Court, May 22, 2025.

All three decisions rejected the plaintiffs’ requests, including Ajola Xoxa, who insisted on the return of the phone and the documents that SPAK had blocked at the height of the December 2024 investigations, a case in which Erion Veliaj is a defendant. The plaintiffs claimed that the searches of that time by the National Bureau of Investigation had occurred in violation of the law.

But the claims were rejected and now in a plenary session, on the basis of the documents, where SPAK will also present concrete objections, the judges will sit again in the large hall to assess the manner in which SPAK carried out searches and seized phones during the last four years.

Earlier, for the Qyno case, the Constitutional Court assessed that summoning the journalist to SPAK to reveal sources and the seizure of the devices has restricted freedom of expression.

While in the Ymeri case, the Constitutional Court declared that correspondence and personal data are protected by the Constitution and that the Special Prosecution could not check all the data on the phone without having a court decision.
