SPAK “targeting other figures to reach Agasi”, former minister: decision made with “political passion”

Former Interior Minister Bajram Yzeiraj has commented on the developments in the SPAK investigation of former SHISH director Vlora Hyseni, who is currently under the security measure of “house arrest”.

Yzeiraj described the approach taken as hasty, arguing that the decision was made with “political passion,” while stressing that the consequences the case could have for the state and the institution should also have been considered.

Yzeiraj also touched on the possible responsibility of the prime minister, arguing that if he had no knowledge of the alleged actions, he cannot be held responsible for them.

The former minister also argued that the Prosecution should apply the Code of Criminal Procedure, but at the same time keep in mind the institutional relations between independent institutions and the government.

“The procedure followed and the way of acting seems to me passionate, hasty, because one should not have thought only about this official. This case could have been resolved differently and the damage that could be done to the institution could have been lower. Even her reaction took the opportunity to deliver a strong blow. In my judgment, there were all possibilities for SPAK to perform its duty and for the state and the institution, in its own image, not to suffer these damages.

It is a hasty and politically passionate decision. State secrets have their documentation listed by legal and sublegal act. So far there is no state secret at all; for the secret of the investigation, it is you who proceed. Even support after the commission of the crime is a criminal offense, but it could have been resolved differently. Did the prime minister have knowledge; if he had and how he resolved it, he has damaged the state. If he had no knowledge, he cannot be blamed.

The Prosecution has the Code of Criminal Procedure, but it also makes criminal policy. The Constitutional Court does not agree with the government; the government with these institutions are independent — these institutional relations, without entering into labor relations, with what eye does SPAK see the government. One must also think about the state. Those two offenses are criminal contraventions; call it national treason. Do not use this security measure to gather evidence against Agasi by targeting other figures; use evidence against Agasi.”
