Criticized for years, Hungary amends its child protection law

Hungarian Prime Minister Péter Magyar has announced changes to the child protection law, which for years has been criticized by Brussels and LGBTQ+ rights organizations over discriminatory provisions.

The law was initially adopted in 2021, during Viktor Orbán’s government, with the declared aim of protecting minors from pedophilia. It was later amended to effectively restrict the portrayal of homosexuality to minors, on the argument that such content could pose a danger to children.

Implementation of the law led to books, newspapers and films being restricted or removed from shelves, as well as restrictions on television programs. Following numerous international criticisms, the European Commission launched infringement proceedings against Hungary.

In April of this year, the European Court of Justice ruled that the legislation was contrary to European Union law. The Court argued that the law treated LGBTIQ+ persons as a threat to society, undermined their human dignity and could contribute to their social exclusion.

Speaking on national radio on Monday, Magyar said the amended version of the law will strengthen the protection of minors from violent and sexual content, while eliminating discrimination against sexual minorities.

“It is very likely that the amendment of the law, in addition to much stronger protection of children, will allow Hungary to avoid the fine,” Magyar declared.
