Interim measure for the Assembly; tomorrow PDK also takes the Government’s election to the Constitutional Court

The Democratic Party of Kosovo has today taken the issue of the constitution of the Kosovo Assembly — namely the manner of election of its speaker and deputy speakers — to the Constitutional Court.

The head of the PDK Parliamentary Group, Arian Tahiri, told journalists that they believe in the work of the Constitutional Court, and that it is important that an interim measure be imposed.

“We have just sent to the Constitutional Court the assessment of the constitutionality of their findings regarding the constitution of the Assembly, the election of the speaker, the manner of election of deputy speakers, the change of the voting procedure for deputy speakers. It is immediate that a measure be imposed first, so that no damage and more serious situations are produced in the legal and institutional sense, because even the Government elected yesterday by an Assembly that is not really constituted and has no legality may continue to take unlawful decisions,” said Tahiri.

He said that for every decision that could be taken by the Assembly and the Government they will turn to the Constitutional Court.

On the other hand, MP Përparim Gruda has warned that on Tuesday they will also submit to the Constitutional Court a request for the assessment of the constitutionality of the Government’s election.

“We cannot continue with the Assembly continuing to elect the central bodies of the state while having such major constitutional dilemmas,” said Gruda.

Gruda emphasized that PDK’s request aims at restoring institutional functioning on the basis of the Constitution.

“We are seeking the restoration of constitutional order, not the establishment of Vetëvendosje’s order. In the Republic of Kosovo the rules are set by the Constitution, not by the political will of a party nor by interpretations that change depending on the interest of the moment,” declared Gruda.

Meanwhile, lawyer Faton Fetahu announced that, alongside the main request, the imposition of an immediate interim measure has also been requested.

“We have asked the Constitutional Court to immediately impose an interim measure, so as to prevent the production of further legal and institutional consequences from a process whose constitutionality is already contested before the Court. Until its decision, no new facts should be created that could deepen the constitutional crisis even further,” said Fetahu.

The request to the Constitutional Court contests the September 9, 2026 decision on the election of the Assembly Speaker, the procedural decision of September 11 on the manner of voting for deputy speakers, as well as the September 13 finding on the constitution of the XI Legislature of the Assembly of the Republic of Kosovo.

PDK asks the Constitutional Court to assess these decisions and procedures and to clearly determine the legal consequences of possible constitutional violations. /Telegrafi/
