DOSSIER / Accused of Abusing Properties: Two Former Cadastre Directors in Fier, the Specialist and the Beneficiary Arrested! Prosecution

Four people were arrested at the request of the Fier Prosecution, as part of an investigation into document forgery and abuse of office, while more than 76 properties with a total area of 1,143 hectares of land were seized, along with 150,000 euros.

Among those arrested are two former directors of ASHK Fier, a legal specialist of the institution and the person suspected of benefiting from the properties.

The Fier Court of First Instance of General Jurisdiction imposed the security measure “Arrest in prison” for E.Sh. and B.K., in their capacity as former directors of ASHK Fier, P.Ç., specialist and legal expert at ASHK, and K.H., the beneficiary of the properties. According to the Prosecution, the investigation was conducted within criminal proceeding no. 1026 of 2025, in cooperation with the Judicial Police of the Fier Local Police Directorate and through the use of proactive methods.

The investigation suspects that K.H. used as property titles two forged decisions of the Fier Commission for the Return and Compensation of Properties. On the basis of these documents, he managed to register in his co-ownership and that of four other persons an area of about 1,143 hectares in cadastral zones 3301 and 3358, in Seman i Ri and Sheq Marinas. He then, according to the prosecution body, presented himself as co-owner and representative of the other co-owners and, through a special power of attorney suspected of being forged, sold the land to two different companies. The Prosecution claims that the former directors of ASHK Fier, E.Sh. and B.K., together with specialist P.Ç., registered the properties in the co-ownership of K.H., in violation of the cadastre legislation and the transitional ownership processes legislation.

“Arrested at the request of the Fier Prosecution for document forgery and abuse of office, two former directors of ASHK, the specialist and the property beneficiary; 1,143 ha of land seized.

At the request of the Prosecution at the Fier Court of First Instance of General Jurisdiction, the personal security measure ‘Arrest in prison’ was imposed on four citizens: E.Sh., B.K. in their capacity as directors of ASHK, P.Ç., specialist, legal expert, at ASHK, and K.H., the beneficiary of the properties, charged with the criminal offences ‘Forgery of documents’, ‘Abuse of office’ and ‘Cleaning of the products of a criminal offence or criminal activity’ as provided by articles 186/2, 248 and 287, paragraph 2, of the Criminal Code.

Likewise, during the investigation, over 76 properties were seized, with a total area of 1,143 hectares of land, as well as 150,000 euros.

The Prosecution at the Fier Court of First Instance of General Jurisdiction, during the investigations so far for criminal proceeding no. 1026 of 2025, conducted in close cooperation with the services of the Judicial Police of the Fier Local Police Directorate, also through the use of proactive methods, managed to prove that:

Citizen K.H., by presenting as property titles two forged decisions of the Fier Commission for the Return and Compensation of Properties, managed to register in his co-ownership and that of four other persons a considerable land area of 1,143 hectares, as well as 150,000 euros located in cadastral zones 3301 and 3358, Seman i Ri and Sheq Marinas, Fier.

Then, this citizen, presenting himself as co-owner and representative of the other co-owners, with a forged special power of attorney, sold this land to two different companies.

Citizens E.Sh. and B.K., in their capacity as directors of ASHK, Fier, and citizen P.Ç., in their capacity as specialist, legal expert, at ASHK, Fier, registered the properties in question in the co-ownership of citizen K.H., in violation of law no. 111/2018, ‘On the cadastre’, and law no. 20/2020, ‘On the completion of transitional ownership processes in the Republic of Albania’, and DCM no. 639, dated 16.10.2024, and Council of Ministers Instruction no. 2, dated 12.09.2012, failing, according to these legal/sub-legal acts, to request the confirmation of the decisions of the Fier Commission for the Return and Compensation of Properties by the Property Treatment Agency — a verification that would have shown these decisions to be forged.

Moreover, it turned out that citizen B.K., former director of ASHK, Fier, when registering property no. 3**, zk 3358, exceeded even the area that, according to forged decision no. 8*, dated 20.01.1997, of the Commission for the Return and Compensation of Properties at the Fier District Council, had been returned to former owner Th.S., as a result of which citizen K.H. benefited from another considerable land area as well.

Also, citizens E.Sh. and P.Ç., during the registration of the properties, changed the cadastral item of the registered area from arable land to non-fruitful land, without an administrative act from the Council of Ministers, the Ministry of Agriculture or the Directorate of Administration and Protection of Land at the Fier County Council.

The personal and asset security measures were executed by the services of the Judicial Police of the Fier Local Police Directorate in cooperation with the services of Police Commissariat No. 2 and No. 3 Tirana, and the Vlorë Local Police Directorate.”
