Montenegro Employment Agency: State Appeals Commission confirms we acted in accordance with the law

The Employment Agency of Montenegro announced that the State Commission for Appeals has rejected the appeal against its decision on the termination of the employment relationship by force of law, thus confirming the legality of its actions in that case. By decision no. UP II 21-102/26-1143/4, the State Commission for Appeals, after reviewing the appeal’s claims and all documentation, assessed the appeal as unfounded and confirmed the Agency’s decision.

In the reasoning of the decision, the State Commission emphasizes that the Law on Civil Servants and State Employees stipulates that the employment relationship of a civil servant or state employee is terminated by force of law when they reach 66 years of age and at least 15 years of insurance service. Examining the legality of the Agency’s decision, the Commission found that in this specific case the legal conditions for termination of the employment relationship by force of law had been met, the Employment Agency’s announcement said.

The Agency recalls that, given the different interpretations of regulations and the different age limits envisaged in the Law on Civil Servants and State Employees and the Labor Law, before making decisions it had sought the opinion of competent institutions, so as to eliminate legal ambiguities and ensure the correct and equal application of the rules.

“Such an action clearly shows that the Agency did not act arbitrarily in that case either, but with special care and with the aim of full legality of its decisions,” the announcement stressed. “The Agency will not allow its work and decisions to be called into question with arbitrary interpretations. The institution will continue to act exclusively in accordance with the law, with responsibility and transparency,” the announcement concludes.
